Refund Policy
This Refund Policy explains how refunds, cancellations, credits, and billing disputes are handled for Thoroughbreds AI.
This policy applies to paid subscriptions, paid reports, and paid enterprise services unless a signed order form, master services agreement, statement of work, or other written agreement with Thoroughbreds AI says otherwise.
Nothing in this policy limits any non-excludable rights you may have under the Australian Consumer Law or any other applicable law.
Plans and purchases covered
Thoroughbreds AI currently offers:
- Free: free access to limited catalogue and scoring features.
- Agent: paid subscription access to the Thoroughbreds AI intelligence layer, reports, predictions, collaboration, exports, My Stable features, and related paid functionality.
- Elite: sales-led access with private recommendations, custom scoring profiles, multi-organisation support, dedicated support, white-label reporting, SLA commitments where agreed, and other contract-specific services.
- Paid reports: one-off report, analysis, prediction, export, or intelligence purchases where offered.
General rule
Paid subscription fees are billed in advance. Once a billing period or committed subscription term begins, fees are non-refundable and non-creditable except where required by law, expressly stated in this policy, agreed in writing, or required because Thoroughbreds AI materially breaches its agreement and does not remedy that breach within a reasonable time.
Cancelling a subscription stops future renewal charges. It does not automatically create a refund or credit for the current billing period or committed subscription term.
Agent subscriptions
Agent subscriptions may be purchased monthly or annually through our approved checkout or billing process.
If you cancel an Agent subscription, your paid access continues until the end of the then-current paid billing period unless we are required by law to do otherwise. We do not provide partial refunds or credits for unused time, unused features, low usage, change of mind, changes in your business needs, or failure to use the service.
Annual Agent subscriptions are priced on the basis of an annual commitment. Monthly payment availability, if offered, does not convert an annual commitment into a month-to-month subscription unless the checkout page or order form clearly says so.
Elite and enterprise subscriptions
Elite and enterprise subscriptions are custom, sales-led arrangements. Refunds, credits, service levels, implementation obligations, renewal terms, cancellation rights, and any committed usage are governed by the applicable order form or written agreement.
Unless that agreement says otherwise, Elite and enterprise fees are non-refundable once the subscription term begins.
Fees for onboarding, configuration, custom reporting, private model setup, white-label work, data migration, training, advisory services, or other professional services are non-refundable once work has started.
Paid reports and one-off purchases
Paid reports, exports, predictions, private analysis, or other one-off intelligence purchases are non-refundable once generation, preparation, delivery, download, or access has started, except where required by law or agreed in writing.
Refunds are not provided because a report, prediction, recommendation, model output, or analysis does not produce a particular commercial outcome.
First-purchase review window
For self-service Agent subscriptions only, Thoroughbreds AI may, at its discretion, offer a first-purchase review window of up to 14 days from the initial purchase date.
A refund under this review window is not available if:
- your organisation has materially used paid features;
- reports, exports, predictions, private analysis, or other paid intelligence outputs have been generated, downloaded, or accessed;
- onboarding, configuration, support, or custom work has started;
- the purchase was a renewal, upgrade, reactivation, or second subscription;
- the request is made after the review window.
This review window does not apply to Elite, enterprise, custom, invoiced, renewal, upgrade, one-off report, or professional services purchases unless expressly stated in writing.
Service problems
If the service does not materially conform to the applicable agreement or published documentation, you must notify us promptly with enough detail for us to investigate.
Where the problem is within our control, our first remedy will usually be to repair, restore, reperform, or provide a workaround for the affected service.
If we materially fail to provide the paid service and cannot remedy the issue within a reasonable time, you may be entitled to a refund or credit for the affected unused portion of the subscription, subject to applicable law and any signed agreement.
We are not responsible for service issues caused by customer systems, third-party services, unsupported devices, incorrect data supplied by you, misuse of the service, unauthorised modifications, network issues outside our control, or use of the service contrary to our documentation or terms.
Predictions, analytics, and AI outputs
Thoroughbreds AI provides analytics, predictions, reports, and AI-generated outputs to support professional judgement. These outputs are not guarantees of sale results, racing performance, breeding outcomes, investment returns, or commercial success.
Refunds are not provided because a prediction, recommendation, report, model output, or analysis does not produce a particular commercial outcome.
Upgrades, downgrades, and plan changes
If you upgrade during a subscription term, we may charge a prorated amount for the upgraded access for the remainder of the term.
Downgrades take effect at the next renewal date unless we agree otherwise in writing. Downgrades do not create refunds or credits for the current term.
If you exceed agreed usage limits, seat limits, organisation limits, or other scope limits, we may require you to upgrade or pay additional fees for the increased usage.
Taxes, payment fees, and currency
Refunds, where approved, will usually be made to the original payment method and in the original transaction currency.
Unless required by law, refunds do not include bank fees, foreign exchange differences, card fees, payment processor charges, or taxes that we are not able to recover.
Billing disputes
You must notify us of any billing dispute within 30 days after the relevant invoice, receipt, or charge date.
Your notice should include:
- account name;
- invoice or receipt number;
- amount disputed;
- reason for the dispute;
- supporting details or documents.
We will review billing disputes in good faith. You must continue to pay all undisputed amounts while a dispute is being reviewed.
Non-payment and chargebacks
If a payment fails, is reversed, or is charged back without a valid unresolved billing dispute, we may suspend or restrict paid access until the account is brought current.
Chargebacks do not cancel your subscription or remove your payment obligations for committed subscription terms.

- invoice or receipt number;
- reason for the request;
- any relevant supporting detail.
We aim to respond within 10 business days.
